FI Tools, LLC Terms of Service
1. Acceptance of Terms
By creating an account with FI Tools, LLC, you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the platform.
2. User Responsibilities
As a user of FI Tools, LLC, you agree to:
- Use the platform only for its intended purpose of managing covered call strategies and investments.
- Provide accurate and truthful information during the account creation process and maintain the security of your account.
- Not misuse the platform, including but not limited to attempting unauthorized access, data scraping, or any other malicious activities.
3. No Financial Advice
FI Tools, LLC is a research tool for covered call investors. We do not offer financial, legal, or investment advice. All decisions regarding investments are your responsibility, and you should consult with a financial professional before making any trades. By using the platform, you acknowledge and agree that:
- Any information, tools, or features provided by FI Tools, LLC are for informational and educational purposes only and should not be considered financial or investment advice.
- FI Tools, LLC does not guarantee the performance or outcome of any trades or investments. You are solely responsible for conducting your own due diligence before making any investment decisions.
- FI Tools, LLC is not responsible for any financial losses, missed opportunities, or other damages that may result from your use of the platform, including trades executed based on data, screeners, or tools provided by FI Tools, LLC.
4. Subscription Fees
FI Tools, LLC offers an annual membership. The standard membership rate is $2,000 per year. Members who join during the founding-member period pay a reduced rate of $1,000 per year, applied via a permanent, recurring discount that persists for as long as the membership remains active and uninterrupted. By creating an account and subscribing, you agree to the payment terms as outlined:
- Payments are handled securely by a third-party provider (Stripe), and FI Tools, LLC does not store your payment information.
- Memberships renew annually. We will send you a renewal reminder at least 30 days before your renewal date so the charge is never a surprise.
- You may cancel your membership at any time by emailing us. We do not run retention flows or "are you sure?" screens.
- Six-month money-back guarantee. You may request a full refund of your membership fee within six (6) months of your initial subscription, subject to the condition described in § 5 below.
- Prorated refunds outside the guarantee window. If you cancel after the six-month guarantee window has closed, we will refund the unused portion of your annual membership on a prorated basis. We are not interested in collecting money from people who are not using the product.
5. Six-Month Money-Back Guarantee
We charge $2,000 a year because we believe the tool delivers far more than that in value for the right person. You should not have to take our word for it.
Use FITools for up to six months. Use the screener. Track positions. See if it changes how you find and manage opportunities. If it does not deliver enough value — for whatever reason — email us and we will refund your membership in full.
The only condition is that you have actually used the tools. Not signed up and never logged in, but genuinely given it a shot. We may reference your account activity to confirm this condition when reviewing a refund request.
5a. Founding-Member Pricing Lock
Members who join during the founding-member period pay $1,000 per year. This founding rate is locked for the life of the membership: as long as the membership remains active and uninterrupted, the founding rate will continue to apply at renewal even after the founding period closes and the standard rate of $2,000 per year applies to new members.
If a founding member cancels and later resubscribes, the standard membership rate in effect at the time of resubscription will apply. Founding-member pricing is not transferable and applies only to the account that originally enrolled during the founding period.
6. Intellectual Property
All content, tools, and features provided on FI Tools, LLC, including design elements, text, graphics, and the platform's functionality, are the exclusive property of FI Tools, LLC and are protected by intellectual property laws.
- You may not copy, distribute, or reproduce any of the materials or services provided on FI Tools, LLC without express written permission.
7. Limitation of Liability
FI Tools, LLC is provided "as is," without any warranties or guarantees of any kind. You agree that FI Tools, LLC will not be held liable for any damages or losses, including but not limited to:
- Financial losses from investment decisions.
- Any interruptions or errors in the platform's functionality.
8. Privacy
Your privacy is important to us. By using FI Tools, LLC, you consent to the collection and use of your personal information as outlined in our Privacy Policy. This includes:
- Information provided during account creation.
- Any data related to your use of the platform.
9. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify users by posting an update on our website or sending an email to registered users. Your continued use of the platform after changes have been made constitutes acceptance of the updated Terms.
10. Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in unauthorized or harmful behavior while using FI Tools, LLC.
11. Governing Law
These Terms and any disputes related to your use of FI Tools shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law principles. By using FI Tools, you agree that any disputes or claims arising out of or related to these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Greenville County, South Carolina.
12. Disclaimer for EU Residents
FI Tools is not currently intended for individuals located in the European Union (EU) or European Economic Area (EEA), and we do not knowingly collect or process personal data from residents of these regions. If you are an EU or EEA resident and believe we may have collected your personal data, please contact us immediately at support@fitools.com, and we will take steps to remove your information from our systems in compliance with relevant regulations.
13. Dispute Resolution and Arbitration
Any disputes arising out of or relating to these Terms or your use of FI Tools, LLC shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will take place in Greenville County, South Carolina, and both parties agree to waive any right to a jury trial or to participate in a class action lawsuit.
Nothing in this clause precludes either party from seeking equitable relief in court to prevent any misuse of proprietary materials or intellectual property.
14. Indemnification
You agree to indemnify, defend, and hold harmless FI Tools, LLC and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees and costs) arising out of or in any way connected with your access to or use of the platform, your violation of these Terms, or any wrongful conduct by you or any other person using your account.
15. Data Processing
By using FI Tools, LLC, you acknowledge and agree that we may collect and process certain personal data necessary for the operation of the platform, in accordance with our Privacy Policy. We will not sell or share your personal data with third parties except as required to provide the services, comply with legal obligations, or protect our legal rights.
16. Force Majeure
FI Tools, LLC shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, strikes, labor disputes, embargoes, government orders, or any other force majeure event.
17. Severability
If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
18. Age Requirement
By using FI Tools, LLC, you affirm that you are at least 18 years of age, or the age of majority in your jurisdiction. If you are under 18, you may not create an account or use the platform.
